Welcome to Anti Mosquito! These Terms of Service ("Terms") govern your use of the Anti Mosquito iOS application ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. Please read them carefully, especially the health and safety disclaimers.

1. Acceptance of Terms

By using Anti Mosquito, you confirm that:

• You are at least 4 years old (or have parental consent)
• You understand the app's limitations and disclaimers
• You accept these Terms in their entirety
• You will not rely solely on this app for health protection

2. Service Description

Free Features (Limited)

The free version includes:

• Single frequency preset (15 kHz only)
• Timer mode limited to 15-minute sessions
• Maximum 3 activation sessions per day
• Basic start/stop controls
• Volume safety settings (50-100% range)

Pro Subscription Features

Pro subscription unlocks:

• Full frequency range (16.5-22 kHz)
• All frequency presets (16, 18, 20, 22 kHz)
• Continuous mode (unlimited duration)
• Extended timer options (30 min, 1 hour, 3 hours, custom up to 8+ hours)
• Sleep mode with screen dimming
• Unlimited daily usage
• Priority support

3. Subscription Terms and Pricing

Available Plans

• Weekly Plan: $3.99/week after 3-day free trial
• Annual Plan: $29.99/year (no trial, best value - save 85%)

Billing and Renewal

• Payment charged to iTunes Account at confirmation of purchase
• Subscription automatically renews unless cancelled 24 hours before period ends
• Account charged for renewal within 24 hours prior to end of current period
• Free trial automatically converts to paid subscription unless cancelled
• Unused free trial portions forfeited upon subscription purchase

Managing Subscriptions

To cancel or manage subscriptions:

1. Open Settings app on your iOS device
2. Tap your name at the top
3. Tap Subscriptions
4. Select Anti Mosquito
5. Choose to cancel or modify

4. Critical Health and Safety Warnings

Effectiveness Disclaimer

IMPORTANT: Scientific evidence for ultrasonic mosquito repellence is mixed and inconclusive. The app:

• May have NO effect on mosquitoes in your area
• Effectiveness varies by mosquito species, many of which are unaffected
• Environmental factors significantly impact any potential effectiveness
• Should NEVER be your only mosquito protection method

Disease Prevention Warning

This app does NOT prevent mosquito-borne diseases including but not limited to:

• Malaria
• Dengue fever
• Zika virus
• West Nile virus
• Chikungunya
• Yellow fever

Always use proven protection methods such as EPA-registered insect repellents, mosquito nets, and protective clothing.

Pet and Animal Safety

WARNING: Ultrasonic frequencies can cause distress to animals:

• Dogs: Can hear up to 45 kHz - may experience discomfort or anxiety
• Cats: Can hear up to 65 kHz - may become agitated or stressed
• Rodents: Extremely sensitive - hamsters, mice, rats may experience severe distress
• Birds: Some species affected - monitor for signs of stress

Immediately discontinue use if pets show signs of distress including but not limited to: agitation, hiding, vocalizing, loss of appetite, or unusual behavior.

Human Safety Considerations

• Children and young adults may hear and be bothered by frequencies up to 20 kHz
• Prolonged exposure to audible high frequencies may cause headaches or discomfort
• Volume safety limit enforced at 50-100% to protect hearing
• Not recommended for continuous use at maximum volume
• May interfere with hearing aids or audio equipment

5. Device and Technical Limitations

Hardware Limitations:

• Most smartphone speakers cannot effectively produce frequencies above 20 kHz
• Older devices may have limited frequency response above 18 kHz
• Speaker quality degrades with device age and use
• Case or screen protectors may muffle high frequencies
• Effectiveness dramatically decreases with distance from device

Software Requirements:

• iOS 17.0 or later required
• Background audio permissions required for continuous operation
• Battery usage increases during operation

6. Acceptable Use Policy

You agree NOT to:

• Use the app as sole protection against disease-carrying mosquitoes
• Make medical or health claims about the app's effectiveness
• Use to intentionally cause distress to people or animals
• Operate at volumes that could damage hearing
• Misrepresent the app's capabilities or effectiveness
• Use in violation of any applicable laws or regulations
• Reverse engineer or modify the app

7. No Medical Claims or Warranties

We explicitly state that Anti Mosquito:

• Is NOT a medical device
• Is NOT FDA approved or evaluated
• Does NOT prevent, treat, or cure any disease
• Does NOT guarantee mosquito repellence
• Is NOT endorsed by health organizations
• Should NOT replace professional medical advice
• Should NOT replace proven mosquito control methods

8. Intellectual Property

All content, features, and functionality of Anti Mosquito are owned by us and protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the app.

9. Privacy and Data

Anti Mosquito does not collect personal data. All settings are stored locally on your device. For complete details, see our Privacy Policy.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• EFFECTIVENESS IN REPELLING MOSQUITOES
• SAFETY FOR ALL USERS OR PETS
• COMPATIBILITY WITH ALL DEVICES
• CONTINUOUS OR ERROR-FREE OPERATION

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any mosquito bites or insect-related incidents
• Transmission of mosquito-borne diseases
• Harm or distress to humans or animals
• Failure to repel mosquitoes
• Device speaker damage from extended use
• Battery drain from app operation
• Any indirect, incidental, special, or consequential damages
• Lost profits or data
• Personal injury or property damage

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE PAST 12 MONTHS.

12. Indemnification

You agree to indemnify, defend, and hold harmless the app developers from any claims, damages, losses, or expenses arising from:

• Your use or misuse of the app
• Your violation of these Terms
• Your violation of any third-party rights
• Any harm caused to people or animals through your use
• Claims related to ineffectiveness against mosquitoes

13. Assumption of Risk

By using Anti Mosquito, you acknowledge and accept that:

• You assume all risks associated with ultrasonic sound exposure
• You understand the app may be completely ineffective
• You will not hold us liable for mosquito-related incidents
• You are responsible for monitoring effects on pets and people
• You will use additional proven mosquito protection methods

14. Termination

We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the app ceases immediately.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified through the app or via App Store update notes. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by applicable laws without regard to conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts in our jurisdiction.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.

18. No Waiver

Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
