Terms of Service - Big Mac Index

                Important: Please read these Terms of Service carefully before using Big Mac Index. By downloading, installing, or using the app, you agree to be bound by these terms.
            

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Lado Tatishvili ("Developer," "we," "us," or "our") regarding your use of the Big Mac Index mobile application ("App").

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Description of Service

Big Mac Index is an iOS application that provides:

Display of Big Mac prices across 60+ countries
Purchasing power parity (PPP) calculations and visualizations
Historical price trend data and charts
Country comparison tools
Currency valuation insights based on The Economist's Big Mac Index methodology

The App is designed for informational and educational purposes only.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your iOS device solely for your personal, non-commercial use.

3.1 License Restrictions

You agree not to:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
Rent, lease, lend, sell, redistribute, or sublicense the App
Use the App for any illegal or unauthorized purpose
Attempt to gain unauthorized access to any portion of the App
Use automated systems (bots, scrapers) to extract data from the App

4. Data Sources and Accuracy

4.1 Third-Party Data

The economic data displayed in the App is sourced from The Economist's Big Mac Index, which is publicly available information. The App is an independent project and is not affiliated with, endorsed by, or connected to The Economist, McDonald's Corporation, or any related entities.

4.2 No Warranty of Accuracy

IMPORTANT DISCLAIMER: While we strive to provide accurate information, the App displays data "as is" based on publicly available sources. We make no representations or warranties regarding:

The accuracy, completeness, or reliability of the data
The timeliness or currency of the information
The suitability of the data for any particular purpose

4.3 Not Financial Advice

The information provided in the App is for informational and educational purposes only. It does not constitute financial, investment, legal, or professional advice. You should not rely on the App for making financial decisions, currency trading, or investment purposes. Always consult with qualified professionals before making any financial decisions.

5. Intellectual Property Rights

5.1 App Ownership

The App, including its design, code, graphics, user interface, and all related materials, is owned by Lado Tatishvili and is protected by copyright, trademark, and other intellectual property laws.

5.2 Third-Party Data Rights

The Big Mac Index data and methodology are property of The Economist. The display of this data in the App is based on publicly available information and does not imply any endorsement or affiliation.

6. User Conduct

You agree to use the App in compliance with all applicable laws and regulations. You agree not to:

Use the App in any way that could damage, disable, or impair the App
Attempt to interfere with the proper functioning of the App
Use the App to harass, abuse, or harm others
Collect or harvest any information from the App using automated means
Circumvent any security features or access restrictions of the App

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
Warranties that the App will be uninterrupted, error-free, or secure
Warranties regarding the accuracy or reliability of data
Warranties that defects will be corrected

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
THIS INCLUDES DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE APP
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM
THESE LIMITATIONS APPLY WHETHER THE LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE

9. Indemnification

You agree to indemnify, defend, and hold harmless Lado Tatishvili from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with:

Your use or misuse of the App
Your violation of these Terms
Your violation of any rights of another party
Your violation of any applicable laws or regulations

10. Updates and Modifications

10.1 App Updates

We may release updates, upgrades, or new versions of the App from time to time. These updates may include bug fixes, feature enhancements, or security improvements. You may need to update the App to continue using it.

10.2 Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

11.1 Termination by You

You may terminate your use of the App at any time by deleting the App from your device.

11.2 Termination by Us

We may terminate or suspend your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

11.3 Effect of Termination

Upon termination, your license to use the App will immediately cease, and you must delete all copies of the App from your devices.

12. Availability and Support

12.1 App Availability

The App requires iOS 26.0 or later. We do not guarantee that the App will be compatible with all devices or operating system versions.

12.2 Support

For support inquiries, please contact us at ladotatishvili@proton.me. We will make reasonable efforts to respond to support requests, but we do not guarantee any specific response time or resolution.

13. Geographic Restrictions

The App is available through the Apple App Store and may be subject to geographic restrictions imposed by Apple or applicable laws. We make no representation that the App is appropriate or available for use in all locations.

14. Apple App Store Terms

Your use of the App is also subject to Apple's App Store Terms of Service and Apple's Licensed Application End User License Agreement (EULA). In the event of a conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to your use of the App Store.

14.1 Apple as Third-Party Beneficiary

Apple, Inc. and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes may be resolved through binding arbitration or in a court of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the extent necessary to make it valid and enforceable while preserving its intent.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding the App and supersede all prior agreements, understandings, or communications.

18. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of the Developer.

20. Acknowledgment

BY USING THE BIG MAC INDEX APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE APP.
